Each entertainer has their say as to what they believe is the right and wrong way to conduct their 'magic business', notice it is a business and therefore should be run as one. A contract or a performance agreement is one way to secure a date and time as well as give a type of security to you and your client. With the proper use of a typed agreement you know that your client has all the details in hand and that there are no questions as to cost, times and or location.
Your clientele also feel as though you are a seasoned professional (many of whom will use your services have utilized a contract or some form of typed agreement in the past), they have a greater confidence in you knowing what it is you do and that you will be there when and where you say and provide services as promised.
Below is a sample of one of several types I use on a regular basis:

Type: Silver birthday party package (Comedy magic show, Games and free goodie bags)
Total performance fee: $__.__ with a deposit of: $__.__(Paid) and a balance of: $__.__
GUARANTEE -- If your children do not laugh, giggle and scream every 10-15 seconds during the 30 minute comedy show you owe me NOTHING - Period
Location: Bill's Pizza and Grill

Special Instructions:

Facilities: A working area suitable for the execution of the performance is required.
Payment: The deposit is due with the signed agreement. Payment of the balance is due at the performance unless otherwise specified in the Agreement.

The Performer is an independent contractor and assumes all responsibility for withholding tax, social security, state tax, public liability, and workman's compensation.
